These Terms & Conditions (“Terms”) govern your use of the FotoKalorie mobile application (“App”), fotokalorie.app (“Site”), and our official social-media pages (collectively “Services”). By downloading, accessing, or using any part of the Services, you agree to be bound by these Terms and by our Privacy Policy (available in-app and on the Site). If you do not agree, do not use the Services.

1. Who we are

2. Using the App

License. We grant you a personal, non-exclusive, non-transferable, revocable license to install and use the App on devices you own or control, solely for non-commercial purposes and in accordance with these Terms.
App stores. Your download and in-app purchase terms are also governed by the rules of the Apple App Store, Google Play, or any other store (“Provider”) from which you obtained the App. In case of conflict, those rules prevail for billing, renewals, and refunds.
Account. You may sign in with Apple, Google, or a passwordless e-mail. You are responsible for maintaining the confidentiality of your login credentials and for all activities that occur under your account.
Age requirement. You must be at least 16 years old (or the minimum age required by local law to consent to data processing without parental consent) to use the App.
Connectivity & device. FotoKalorie requires an internet connection for backup, AI analysis, and subscription validation. Data charges may apply. Keep your device secure and updated; we are not liable for issues caused by rooted/jail-broken devices or outdated OS versions.
Updates & availability. We may modify, suspend, or discontinue any part of the Services at any time. We may release updates that are required to keep using the App.

3. Subscriptions and payments

Plans. The App is free to download. Core features, such as manual calorie logging and a limited number of daily photo analyses, are free. FotoKalorie Premium unlocks unlimited AI-powered photo analysis, detailed macronutrient tracking, and any future premium features.
Billing. Subscriptions are handled by your Provider through in-app purchase. Prices, billing cycle (monthly or annual), and any free trial period are shown before purchase.
Auto-renewal. Subscriptions renew automatically unless cancelled at least 24 hours before the end of the current period. Manage or cancel in your App Store / Play Store settings. Deleting the App does not cancel your subscription.
Refunds. All refunds are processed by the Provider following its own policies. FotoKalorie cannot access your payment information or issue refunds directly.
Changes. We may change prices or subscription terms; any changes apply at the next renewal and you will be notified in advance.

4. Acceptable use

You agree not to:

violate any law or third-party right;
reverse-engineer or modify the App beyond normal settings;
upload malware or interfere with servers or networks;
use the Services to build a competing product;
share harmful, hateful, or illegal content.

We may suspend or terminate your access if you breach these Terms.

5. Intellectual property

All trademarks, logos, text, graphics, and other materials in the Services are owned by FotoKalorie or our licensors and protected by intellectual-property laws. You may share screenshots of your meal logs or nutritional summaries for personal, non-commercial commentary with proper attribution. Any other reproduction, distribution, or commercial use requires prior written consent.

6. Health & medical disclaimer

FotoKalorie provides nutritional estimation and food logging tools; it is not a medical device, and its information does not constitute medical or dietetic advice. It is not a substitute for professional diagnosis or treatment.

Consult a qualified healthcare provider or registered dietitian before making significant changes to your diet or if you have any medical condition, including but not limited to eating disorders, diabetes, or food allergies.
The nutritional information provided by the App is an estimate generated by AI and user input; we do not guarantee its accuracy. Always check product labels for precise information.
Use of the App is entirely at your own risk.

7. Limitation of liability

To the fullest extent permitted by law, FotoKalorie and its affiliates will not be liable for indirect, incidental, special, consequential, or punitive damages, or any loss of data, revenue, or profits, arising from your use of the Services. Our aggregate liability for any claim shall not exceed the amount you paid to us (if any) during the 12 months preceding the claim.

8. Indemnity

You agree to indemnify and hold harmless FotoKalorie and its officers, employees, and agents from any claims, damages, and expenses arising out of your misuse of the Services or violation of these Terms.

9. Governing law

These Terms are governed by Polish law, and any disputes shall be resolved in the courts of Warsaw, Poland.

10. Changes to these Terms

We may update these Terms at any time. Material changes will be announced in-app or on the Site at least seven days before they take effect. Continued use of the Services after changes become effective constitutes acceptance of the revised Terms.
